The United States has a long tradition of laws that regulate gambling. These include state laws enacted in order to prevent the operation of unlawful casinos. Additionally, the Travel Act applies to Internet casinos and players using interstate facilities for unlawful activities.

Other statutes include: 31 U.S.C. 5362 (10) (A), defining unlawful Internet gambling as involving placing bets, transmitting bets, or wagers over the Internet, or using the internet to receive bets, or wagers, on a given event or outcome).

Section 1956 also provides for launderence for international purposes, concealing and evading taxes, and for use in law enforcement stings. The law has been challenged on constitutional grounds, but so far has failed. For example, in United States v. Grey, a judge held that a bartender or manager of an establishment with video poker machines could be arrested for laundering.

Although the law against gambling has been upheld by courts, many questions have been raised. One challenge focuses on the Commerce Clause, which has been used to justify criminal penalties for some forms of Internet gambling.

Another argument is the First Amendment, which guarantees free speech. Since the activities involved in gambling are commercial, and since they involve financial transactions in the United States, this has proved to be a difficult defense to present.

The UIGEA is also under attack, and it has been charged with violating 18 U.S.C. 1955. A criminal case has been brought against the Internet poker operators of K23 Group Financial Services.

The Federal Communications Commission has a jurisdiction over common carriers. It has the authority to cease or refuse to continue maintaining facilities, or to discontinue furnishing them. Similarly, the FCC has authority over leasing and renting facilities.

Although the laws against illegal gambling on the Internet are based in federal statutes, many state officials have expressed concern about the potential of the Internet to facilitate the conduct of unlawful gambling in their jurisdictions. However, this concern seems to have been tempered by the fact that the commercial nature of the gambling business has been proven to be a sufficient protection against the Commerce Clause.

As a result, the government’s policy on Internet gambling has been strengthened. Nonetheless, the state’s power to regulate gambling is still on the line.
